Definitions
"Platform" refers to the online service known as Monkspace, owned and operated by Artcomun Technologies INC, which enables users—particularly artists—to showcase, share, and monetize their creative works via web-based tools and community interactions.
"User" means any individual or entity who accesses, registers for, or interacts with the Platform in any capacity, including but not limited to Visitors, Buyers, Artists, and Subscribers.
"Visitor" refers to individuals who browse the Platform without uploading content or making purchases. Visitors may engage by liking, following, or exploring Artist profiles and collections.
"Artist" refers to a User who uploads and publishes their original creative works on the Platform for public display or community engagement. Artists may subscribe to premium plans, access promotional tools (e.g., Spotlight), and manage their profile via the Dashboard. An Artist may choose to monetize their content or not.
"Seller" refers to a user who actively lists and sells artworks, digital products, or creative services via the Platform, either directly or through Stripe Connect. Sellers are subject to additional responsibilities and conditions outlined in the separate Seller Terms and Conditions, which form an integral part of the overall contractual framework. All Sellers are Artists, but not all Artists are necessarily Sellers.
"Buyer" refers to a User who purchases artworks or digital products listed by Artists on the Platform.
"Subscriber" means an Artist who has subscribed to a paid plan in order to unlock additional features, higher limits, or promotional tools not available under the Free Plan.
"Subscription" refers to the recurring paid plan offered by Monkspace to Artists. Subscriptions grant access to premium tools, advanced analytics, or content limits beyond those in the Free Plan.
"Free Plan" is the default no-cost tier available to Artists, providing basic tools such as a public profile, limited uploads, and a personalized subdomain (e.g., artistname.monkspace.io).
"Dashboard" is the private interface available to Artists where they can upload content, manage their portfolio, view visitor statistics, and access monetization and promotional tools.
"Spotlight" refers to a promotional feature that increases an Artist’s visibility through highlighted placement, featured listings, or homepage promotion within the Platform.
"Content" refers to any material uploaded or shared on the Platform, including artworks, text, images, videos, and profile data, whether public or private.
"Stripe Connect" is the third-party payment integration used by Monkspace to process secure financial transactions between Artists and Buyers.
Description of Services
Monkspace is a SaaS-enabled social media platform that enables artists to upload, publish, and showcase their creative works. Visitors can engage with these works by liking, following, and curating personal collections. Artists may also subscribe to premium features and receive payments through integrated third-party services such as Stripe.
Account Creation & User Responsibilities
- Users must create an account to access certain features of the Platform. Account registration requires a valid email address, which must be verified before the account becomes active. Users may also register via Google, Apple, or Facebook login modules.
- There is no age restriction for general use of the Platform. However, Users who intend to monetize content or receive payments via Stripe must be at least 18 years old.
- Each User is allowed to maintain only one account. All activities, whether as a visitor or as an artist, must be conducted from this single account.
- Users are responsible for maintaining the confidentiality of their login credentials and for all activities that occur under their account.
- Artists are granted access to a specialized management panel (“Dashboard”) where they can upload products, view visitor information (such as name and surname), and utilize tools such as “Spotlight” to increase visibility on the Platform.
- Users are solely responsible for all content they upload or share via the Platform. Monkspace does not assume responsibility for any user-generated content. Any objectionable content may be reported to info@monkspace.io.
- Users agree not to upload content that infringes upon the intellectual property, privacy, or rights of any third party.
Subscription & Payments
Subscription Plans & Renewals
Monkspace offers tiered subscription plans to Artists, available in monthly, annual, and biennial (every two years) durations. Each plan unlocks varying levels of access to features such as artwork uploads, promotional tools, analytics, and customization options.
Current subscription offerings include:
- Monthly Plan: Renews every month; ideal for short-term or trial access to premium features.
- Annual Plan: Renews every 12 months; includes discounted pricing compared to the monthly plan.
- Biennial Plan: Renews every 24 months; offers the lowest rate per month and may include additional perks such as a complimentary custom domain.
All subscriptions are set to automatically renew at the end of each billing period unless canceled in advance via the user's dashboard. Users may cancel their subscription at any time; the cancellation will take effect at the end of the current billing cycle.
Monkspace reserves the right to change the pricing of its subscription plans at any time, at its sole discretion, and is not required to provide prior notice. However, price changes do not affect any existing, already purchased subscription periods.
Refund Policy
Users are eligible for a 14-day no-questions-asked refund from the date of subscription. To request a refund, users must contact info@monkspace.io within this period. If the subscription includes a complimentary custom domain and that domain has already been activated, the cost of the domain will be deducted from the refunded amount.
Payments & Transactions
Payments on Monkspace may be completed through Stripe Connect, our integrated third-party payment provider, or directly between Users where applicable. Monkspace does not handle or store payment information directly.
For payments processed through Stripe Connect, Monkspace provides a secure transaction flow and facilitates order tracking. However, Monkspace is not a party to the transaction itself and shall not be held liable for payment disputes, chargebacks, or delays caused by the payment provider.
In the case of direct payments (e.g., offline transactions arranged between the Artist and Buyer), Monkspace assumes no responsibility for the transaction, delivery, refunds, or any resulting disputes. Users engaging in direct transactions do so entirely at their own risk.
Artists set their own prices for works sold on the Platform and may update these prices at their discretion. All purchases are considered final unless otherwise specified in the refund policy.
Unless otherwise stated, purchases do not transfer full intellectual property rights of the work to the Buyer. Buyers receive only a non-commercial, limited license to use or display the purchased work, unless explicitly stated by the Artist. Commercial use, redistribution, or modification is not permitted without the Artist’s prior written consent.
Monkspace does not guarantee the quality, authenticity, or timely delivery of artworks and is not involved in the logistics or fulfillment of any sale.
Taxes & Local Compliance
Monkspace does not directly collect or remit taxes such as VAT, sales tax, or KDV. All payments are processed through Stripe Connect, which may apply and calculate taxes automatically depending on the buyer's location and applicable laws. However, Monkspace itself is not responsible for determining or remitting these taxes unless required by law.
Artists are solely responsible for understanding and complying with tax obligations in their own jurisdictions, including income tax, value-added tax (VAT), or any other applicable local taxes. If required by law, Artists must issue invoices or tax documents to Buyers and report income according to the rules of their country.
Stripe may automatically generate transaction receipts for Buyers, but these do not replace official tax invoices. It is the Artist’s responsibility to issue any legally required invoices or documentation for their sales.
For Artists based in the European Union, Monkspace operates as a neutral intermediary and does not act as a VAT-registered supplier. It is the responsibility of EU-based Sellers to comply with VAT obligations under the OSS (One-Stop Shop) or MOSS system, where applicable, and to issue VAT-compliant invoices if required by law.
For Artists based in Türkiye, applicable Value-Added Tax (KDV) obligations may arise when selling to Buyers within the country or abroad. Sellers are responsible for registering with the tax authorities and complying with relevant invoice and tax reporting rules in Türkiye.
Monkspace recommends that all Sellers consult with local tax advisors to ensure compliance with country-specific regulations, including VAT thresholds, e-invoicing, and international digital sales policies.
User Content & Usage Rights
- Users retain full control over the content they upload to the Platform. They may choose to delete their content permanently or temporarily unpublish it at any time via their account settings.
- Monkspace reserves the right to remove, restrict, or suspend access to any content that violates these Terms, applicable laws, or is subject to complaints, including but not limited to intellectual property infringement, hate speech, or inappropriate material.
- Deleted content may be retained on the Platform’s servers for a limited time for technical, security, or legal purposes. The retention period shall comply with applicable data protection laws and internal data retention policies.
- By default, content published on the Platform is publicly visible and accessible to all visitors. Artists may have limited control over visibility and settings related to visitor interactions, such as choosing whether their visitors' names are visible after profile visits.
- In the event of a subscription downgrade, certain content or features associated with paid plans may be restricted, removed from public view, or deleted. This action is initiated automatically by the Platform and subject to a 1-year retention period for potential reactivation through upgraded plans.
- By uploading content to the Platform, Users grant Monkspace a non-exclusive, royalty-free, worldwide license to use, display, and promote such content for the purpose of marketing, public relations, or Platform-related communications.
- Deleted content may be retained for up to twelve (12) months for security and legal purposes.
Artist on Monkspace
Artists who use the Platform to publish or sell artworks are considered Users and are bound by these Terms.
- In addition to general User responsibilities, Artists are solely responsible for verifying Buyers after an order, confirming sales within two (2) days, and ensuring the safe and timely delivery of their artworks. Monkspace is not involved in the fulfillment or logistics of any transaction.
- Artists must ensure that their listings are accurate and not misleading. They are also responsible for complying with all applicable tax, intellectual property, and consumer protection laws in their respective jurisdictions.
- Further details and requirements for Artists are outlined in the separate Artist Responsibilities document, which forms an integral part of these Terms.
Dashboard & Spotlight Usage
Monkspace provides Artists with access to proprietary features, including but not limited to the Dashboard and Spotlight, designed to facilitate content management, visibility, and audience engagement.
1. Dashboard
The Dashboard is a private interface accessible to Artists, which enables them to:
- Upload and manage artworks or other content,
- Track performance analytics such as visitor activity,
- Adjust visibility settings,
Access promotional tools including Spotlight.
Artists are solely responsible for the content they upload and for managing how their profile appears publicly. Monkspace does not guarantee the accuracy of visitor data or analytics and may modify or restrict dashboard tools at its discretion.
2. Spotlight
Spotlight is a promotional feature that offers increased visibility across the Platform via homepage placement, curated selections, or other featured areas. Use of Spotlight is subject to the following conditions:
- Only Artists with active subscription plans may access Spotlight;
- Monkspace reserves full editorial control over Spotlight placement and display order;
- Spotlight does not guarantee traffic, sales, or engagement metrics;
- Artists must ensure the accuracy and compliance of all content featured in Spotlight.
Any misuse of these features—including deceptive listings or manipulation of visibility data—may result in the temporary or permanent suspension of access to Spotlight or Dashboard.
Website & Domain Services
Monkspace offers Artists the ability to create a personalized artist website using either a subdomain (e.g., artistname.monkspace.io) or a custom domain registered through a third-party provider. Access to these services may require an active subscription.
Artists are fully responsible for the content published on their website and for maintaining it via the Dashboard. Monkspace provides the technical infrastructure but does not moderate or guarantee the availability, performance, or search engine ranking of any individual website.
When using a custom domain, the Artist is responsible for domain configuration, renewal, and DNS management unless otherwise agreed. If a complimentary domain is included in a subscription plan and is activated, the cost of the domain may be deducted from any applicable refund.
Monkspace reserves the right to suspend or remove websites that violate the Terms of Use, applicable laws, or involve prohibited content or fraudulent activity.
Prohibited Conduct
Users of the Platform are strictly prohibited from engaging in any of the following behaviors:
- Posting or distributing spam or repetitive content.
- -Uploading content that infringes upon the intellectual property rights of others, including artworks that the User does not own or have permission to use.
- Using discriminatory, hateful, or offensive language targeting race, gender, ethnicity, religion, sexual orientation, or other protected characteristics.
- Sharing personal data or private information of others without explicit consent.
- Uploading or distributing sexually explicit, pornographic, or otherwise inappropriate material.
- Engaging in fraudulent behavior, including impersonation, misrepresentation, or deceptive conduct.
- Pretending to be another individual or entity, including public figures or other Artists on the Platform.
- Attempting to manipulate, disrupt, or compromise the integrity, security, or performance of the Platform through unauthorized access, hacking, or automated tools.
- Monkspace reserves the right to remove any content that violates these rules, suspend or terminate the accounts of offending users, and take legal action in cases of repeated or severe misconduct. Violations may be reported to info@monkspace.io.
Intellectual Property & Copyright
- Users retain full ownership of all original content they upload to Monkspace. By uploading content, Users confirm that they either own the intellectual property rights to such content or have obtained the necessary licenses to upload, share, and publish the material on the Platform.
- By publishing content on Monkspace, Users grant Artcomun Technologies INC a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute the content for promotional, marketing, and communication purposes. This license includes the right to feature the Artist’s name, public profile, biography, portfolio visuals, and non-sensitive metadata (e.g., number of followers, listed works, artwork titles) across Monkspace-owned or affiliated channels—including but not limited to the website, social media, newsletters, exhibitions, advertising campaigns, or third-party collaborations.
- This promotional license excludes the use or disclosure of any sensitive or private information such as financial data, bank account details, account earnings, residential addresses, or private contact information.
- Content uploaded to Monkspace may not be used by the Platform for purposes such as NFT minting, blockchain deployment, or the training of artificial intelligence systems without the Artist’s prior written consent. Monkspace will issue a separate policy specifically governing the treatment of user content in relation to AI technologies.
- Users may not upload any content that infringes upon the intellectual property rights of others. In particular, Users must ensure that any third-party elements, such as stock assets, fonts, or collaborative works, are used with appropriate licensing and permission.
- If a User or rights holder believes that any content hosted on Monkspace violates their intellectual property rights, they may contact us at info@monkspace.io with a detailed complaint. Monkspace will investigate such claims and, if necessary, remove or restrict access to infringing content.
- All rights, title, and interest in and to the Platform itself—including but not limited to its design, functionality, software code, and brand identity—are the exclusive property of Artcomun Technologies INC and are protected under applicable copyright, trademark, and intellectual property laws.
Profile Visibility & Data Sharing in Transactions
Monkspace includes interactive features that allow Users to view Artist profiles, initiate transactions, and engage in direct communication. As part of these features, certain visibility and data-sharing mechanics are in place to support transparency and buyer-seller interaction.
By using the Platform, Users acknowledge and accept that certain personal data, such as profile name, photo, and contact information, may be visible or shared under specific circumstances outlined below.
Public Profile Visibility
When a User views an Artist’s public-facing space—such as their public profile, personalized portfolio page, or subdomain-based website (e.g., artistname.monkspace.io)—their username and profile picture may become visible to the Artist as part of the Platform’s engagement and transparency features.
This feature is designed to encourage meaningful interaction between Artists and their audience, similar to professional networking environments.
Users can manage the visibility of their visit history through the Privacy Settings in their account dashboard. By default, profile visit visibility is turned on.
Artists may not use visit information for unsolicited contact, spam, or any activity that violates Monkspace’s Terms of Use or Privacy Policy.
Order-Based Contact Sharing
For transactions processed under Buyer Protection (via Stripe Connect), certain personal information is shared to facilitate order fulfillment and communication.
- Upon order placement, the Buyer’s contact details—including name and email address—are shared with the Artist.
- Once the Artist approves the order, their contact details—including name and email address—are shared with the Buyer.
This exchange enables both parties to arrange logistics, confirm order details, or resolve issues if needed.
Artists and Buyers must use the shared contact information solely for transactional purposes. Any misuse—including unsolicited communication or promotional outreach—is strictly prohibited and may lead to suspension from the Platform.
User Controls
Monkspace provides Users with control over the visibility of their activity and personal data sharing settings.
Users can choose whether their profile visit history is visible to Artists by adjusting the relevant setting in their Privacy Settings panel. This feature is enabled by default, but can be disabled at any time.
Regarding transactions, personal contact information is shared only in the context of a confirmed order (under Buyer Protection) and is limited to the necessary parties involved in the transaction.
Monkspace does not publicly display Users’ contact details and does not sell or share personal information with third parties outside the scope of the Platform’s functionality.
Platform Responsibility
Monkspace enables certain visibility and data-sharing features to facilitate engagement and transactional functionality between Users. These features operate automatically based on user actions and settings.
While Monkspace provides the infrastructure for such exchanges, it does not monitor, verify, or take responsibility for how Users utilize the shared information outside the scope of the Platform.
Users are solely responsible for managing their privacy preferences and for the conduct of any communication that occurs as a result of data sharing. Misuse of visibility features or contact information may result in account restrictions or removal from the Platform.
Monkspace disclaims all liability arising from direct interactions between Users unless otherwise stated by applicable law.
Our Rights
Monkspace reserves the right to manage and evolve the Platform at its sole discretion. This includes the right to:
- Modify, add, or remove features, services, or functionality of the Platform without prior notice;
- Monitor, restrict, filter, or remove content or accounts that violate these Terms or impact the integrity of the Platform;
- Automatically or manually adjust user-submitted content (such as thumbnails, image ratios, or metadata) for formatting, presentation, or optimization purposes;
- Determine and alter how content is displayed, recommended, or prioritized across the Platform;
- Enforce content moderation rules and community guidelines;
- Refuse service to any User or Artist who engages in behavior that is abusive, harmful, or unlawful.
These rights are exercised to maintain the quality, safety, and continuous improvement of the Platform and its services.
Limitation of Liability
The Platform is provided on an "as is" and "as available" basis. Artcomun Technologies INC makes no warranties or guarantees regarding the availability, reliability, or performance of the Platform, and does not guarantee uninterrupted or error-free operation.
To the fullest extent permitted by applicable law, Monkspace shall not be held liable for any damages resulting from:
- Any interruption or unavailability of the Platform;
- Errors or delays caused by third-party services, including payment processors such as Stripe;
- User-generated content, including but not limited to copyright infringement, defamation, or data loss;
- Unauthorized access to or use of your account due to the User’s negligence or failure to maintain security.
- In no event shall Artcomun Technologies INC’s total liability exceed one hundred United States dollars (USD 100), regardless of the cause or nature of the claim.
Certain jurisdictions may not allow some of the exclusions or limitations set forth above, so these may not fully apply to all Users.
Data Security & Breach Liability
While Monkspace implements commercially reasonable security measures to protect User data, no system is completely immune to unauthorized access or cyber threats. In the event of a data breach, Monkspace will take immediate steps to investigate, notify affected users, and mitigate any potential harm in accordance with applicable data protection laws.
To the maximum extent permitted by law, Monkspace shall not be held liable for damages resulting from cyber attacks, data theft, system outages, or unauthorized access, unless such incidents are proven to have occurred due to Monkspace’s gross negligence or willful misconduct.
Cancellation, Termination & Suspension
Users may cancel and permanently delete their accounts at any time through their account settings. Upon cancellation, the User’s public profile and all published content will be removed from public view. However, certain data—including account records, order history, and transaction metadata—may be retained for up to twelve (12) months for internal use, security measures, or compliance with applicable legal and regulatory obligations.
Monkspace reserves the right to suspend or permanently terminate any User account, without prior notice, under the following conditions:
- The User violates these Terms of Use or any applicable law;
- Fraudulent, abusive, or suspicious activity is detected;
- The User engages in copyright infringement or intellectual property violations;
- Payment obligations are not met, including failed subscription renewals.
Deleted or suspended accounts may be eligible for reactivation unless permanently banned due to repeated or serious violations.
Monkspace retains limited user data for up to twelve (12) months after account deletion or suspension. This includes, but is not limited to, transaction records, customer support logs, and system-generated metadata. Retention beyond this period may occur where required by law (e.g., tax, anti-fraud, or financial regulations).
In accordance with data protection laws such as the General Data Protection Regulation (GDPR) and Türkiye’s KVKK, Users may submit a request for the complete erasure of their personal data by contacting info@monkspace.io. Monkspace will review and honor such requests unless retention is legally required or contractually justified.
Monkspace does not share personal data with third parties beyond what is necessary for secure payment processing, fraud detection, or essential technical infrastructure services.
We reserve the right to pursue legal action in cases of abuse, fraud, or repeated violations of these Terms.
Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
In the event of any dispute, controversy, or claim arising out of or relating to these Terms or the use of the Platform, the parties shall first attempt to resolve the matter amicably through good-faith negotiations and mediation.
If the dispute cannot be resolved through mediation, it shall be submitted to final and binding arbitration under the rules of the American Arbitration Association (AAA). The arbitration shall take place in Delaware, in the English language, and the decision of the arbitrator shall be enforceable in any court of competent jurisdiction.
Notwithstanding the above, either party may seek injunctive or equitable relief in the courts of Delaware to prevent actual or threatened infringement of intellectual property rights or unauthorized access to the Platform.
Force Majeure
Monkspace shall not be liable for any failure or delay in the performance of its obligations under these Terms due to events beyond its reasonable control, including but not limited to: natural disasters, war, terrorism, civil unrest, labor strikes, government actions, power outages, internet failures, pandemics, or other unforeseeable and unavoidable circumstances (“Force Majeure Events”).
In such cases, Monkspace’s obligations shall be suspended for the duration of the Force Majeure Event. Users will be notified where reasonably possible.
Amendments & Updates
Artcomun Technologies INC reserves the right to modify, update, or replace these Terms of Use at any time, in its sole discretion. Users will be informed of any material changes via one or more of the following methods: (i) email notification, (ii) in-app notification on the Platform, or (iii) publication on the Monkspace website. Continued use of the Platform after such changes have been posted constitutes acceptance of the revised Terms. If a User does not agree to the updated Terms, they must stop using the Platform. It is the User’s responsibility to review the Terms periodically to stay informed of any changes.
